Article 352 National Emergency | 42nd and 44th Amendment of Indian Constitution

Part 18 of the Indian Constitution covers the Emergency Provisions from Article 352 - Article 360. Article 352 talks about National Emergency or Proclamation of Emergency.

The provision for the suspension of fundamental rights had been taken from = Weimar Constitution
The idea of emergency in Indian constitution was taken from = Government of India Act, 1935.

Article 356 = State Emergency
Article 360 = Financial Emergency

- 2nd Proclamation of Emergency (India - Pakistan, 1971

- Important Amendments regarding Emergency:-
-38th Amendment
-39th Amendment

-42nd Amendment: This is the most controversial amendment in Indian Constitutional history. 42nd Amendment is very important as it did major changes in the federal structure of the Indian Constitution - it is also known as Mini-Constitution

-and 44th Amendment - which was mainly introduced to do away with the changes of the 42nd Amendment. Both 42nd and 44th amendment are very important topics of proclamation of national emergency.
