Police report:
“On April 11th 2021, while on marked uniform patrol with the City of Fort Myers Police Department, Officer Smith was dispatched in reference to a female driver passed out behind the drivers wheel.

While en route, the Communications Division advised officers the female was passed out behind the wheel while her vehicle was parked in the middle of the road.

Upon arrival, Officer Smith observed a black Lexus stopped in the middle of the road of the RaceTrac gas station. Officer Smith observed a white female in the passenger seat with the vehicle on. Officers asked Kimberly to turn off the vehicle and to step out to evaluate her for any medical concerns. While speaking with her, Officer Smith could smell the odor of an alcoholic beverage emitting from her facial area as she spoke. Officer Smith also noted her eyes were red, glassy, and water.

At this point, Officer Smith asked her if she was willing to participate in Field Sobriety Exercises, she agreed. Officer Smith conducted FSE’s under the overhead pavilion at RaceTrac gas station. Officer Smith noted the area was dry, well lit, leveled, and free of any debris.

Horizontal Gaze Nystagmus:

Officer Smith asked her if she wears glasses or contacts, she replied no. Officer Smith explained the instructions in which she confirmed she understood. Officer Smith observed her eyes to track equally and her pupil to be of equal size. Officer Smith also observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees in both eyes. She had to be reminded several times to track with her eyes only.

Walk and Turn:

Officer Smith explained the walk and turn instructions to her. She confirmed she understood. Officer Smith offered her the opportunity to complete the exercise either barefoot or in her black open-toe sandals. She advised Officer Smith she fractured her right femur, but would continue with the exercise. Officer Smith observed the following clues:

*Could not keep balance during instructions

*missed heel-to-toe on every step on her second pass

*turned in a manner not demonstrated by the officer

*took an incorrect number of steps
She took a total of 10 steps on both passes down the line

One-leg Stand:

Officer Smith explained the instructions and she confirmed she understood. Officer Smith noted she used her arms for balance, put her foot down numerous times, and hopped on her leg to maintain balance.

Based on the observations mentioned above, Officer Smith placed her under arrest for DUI. She refused to submit to a lawful breath test.”
