On Tuesday, April 23, the Federal Trade Commission (FTC) issued its final rule on noncompetition agreements, essentially prohibiting all employers from using such agreements. The rule, slated to take effect on or about August 21, 2024, not only bars employers from entering into new noncompetition agreements but also voids existing ones. Business groups have already started filing lawsuits to block the rule, alleging that the FTC does not have the constitutional authority to issue it.
